Terms of service

TERMS AND CONDITIONS


1. Definitions

(a) Company: Refers to Videocraft Australia Pty Ltd (ACN 065 480 579) of 148 Highbury Road, Burwood, VIC 3125, or Videocraft Equipment Pty Ltd (ACN 097 262 176) of Unit 20, 39 Herbert Street, St Leonards, NSW 2065, or any related body corporate of either entity.

(b) Customer: The individual or entity hiring or purchasing the Equipment from the Company, including all persons acting on behalf of or under the instructions of the Customer.

(c) Equipment: The items listed in the contract or invoice.

(d) Hire Charge: The fee specified for the hire of the Equipment, inclusive of applicable taxes and duties.

(e) Purchase Price: The price for the sale of the Equipment, inclusive of applicable taxes and duties.

(f) Term: The rental or contractual period as specified in the invoice or contract.


2. Terms and Conditions

The Equipment is hired or sold strictly under these terms and conditions. Any modifications proposed by the Customer are not valid unless expressly agreed upon in writing by the Company.


3. Hire of Equipment

  • The Company hires out Equipment for the specified Term, and the Customer agrees to pay the Hire Charge.
  • The Hire Charge must be paid in full before the Equipment is removed from the Company's premises unless the Customer has an approved account (30-day payment terms apply).
  • In case of hire cancellation, the Company may charge a cancellation fee of 50% of the Hire Charge.

4. Sale of Equipment

  • The Company sells Equipment to the Customer at the Purchase Price, which must be paid in full before removal from Company premises, unless the Customer has an approved account (30-day payment terms apply).
  • The Company endeavors to keep pricing and product descriptions accurate but reserves the right to correct any errors, including underpricing and incorrectly advertised products.
  • If a product is mistakenly listed at an incorrect price, or the incorrect product is advertised, the Company reserves the right to cancel orders and issue refunds for any overcharged or undercharged amount.
  • In-store pickups are available at Melbourne (Burwood) and Sydney (St. Leonards) locations; Customers should wait for confirmation before collecting.
  • High-value online orders may require additional identity verification before dispatch.

Product Information, Specifications and Images

  • Product descriptions, specifications, capacities, images, videos, datasheets and other product content are either prepared by the Company or supplied to the Company by manufacturers, distributors and other third parties. While the Company takes reasonable care to publish accurate information, this content may contain errors or omissions, may be out of date, and manufacturers may change specifications, inclusions or packaging without notice.
  • The Company is not responsible for errors or omissions in documentation, images, specifications or marketing material supplied by a manufacturer or distributor, but will work with the Customer to reach a fair outcome where such an error has affected an order.
  • Where there is any inconsistency between the product title, the manufacturer part number or SKU, the product image and the written description or specifications, the manufacturer part number or SKU ordered is the definitive identifier of the Equipment supplied.
  • Where Equipment is sold as a bundle, kit or package assembled by the Company, the contents of that bundle are defined by the list of manufacturer part numbers or SKUs stated on the listing as being included. That list prevails over any conflicting capacity, specification or descriptive text stated elsewhere on the listing.
  • If the Customer requires a specific capacity, specification, inclusion or feature, the Customer should confirm this with the Company in writing prior to placing an order.

Listing Errors and Remedies

  • Where a listing error is identified before dispatch, the Company will contact the Customer, advise the correct details, and offer the Customer the choice of proceeding with the order as corrected or cancelling the order for a full refund.
  • Where a listing error is identified after dispatch and the Equipment supplied does not match the description relied on by the Customer, the Customer should notify the Company within 7 days of receipt. The Company will arrange return of the Equipment at the Company's cost and provide a full refund, or agree an alternative remedy with the Customer such as a partial refund or a replacement.
  • A claim under this clause is a claim that the Equipment did not match its description. It is not a change of mind return and is not subject to the change of mind exclusions or restocking fees in Section 5.
  • Nothing in this clause limits, excludes or modifies the Customer's rights under the Australian Consumer Law, including the consumer guarantee that goods will match their description.

Required documents for verification:

  1. A valid Australian Driver’s License matching the delivery address.
  2. A recent utility bill (within the last three months) matching the order details.
  3. A copy of the front and back of the credit card used for payment.

5. Returns and Refund Policy

When Returns Are NOT Accepted:

Under Australian Consumer Law, returns are not accepted for:

  • Change of mind
  • Incorrectly ordered products
  • Finding a cheaper price elsewhere
  • Awareness of stock availability before purchase
  • Cash flow management
  • Products with known defects disclosed before purchase
  • Products damaged due to misuse
  • Normal wear and tear

The Company reserves the right to provide a remedy at its discretion. A restocking fee of up to 30% may apply for returned goods in resellable condition.

Change-of-Mind Refunds:

  • Not applicable to sales, laybys, deposits, reserved or pre-ordered stock after 7 days.

These exclusions do not limit, exclude or modify the Customer's rights under the Australian Consumer Law where goods are faulty, not fit for purpose, or do not match their description. Where Equipment does not match its description, the remedies in Section 4 apply.


6. Obligations of the Customer

For hire agreements and unpaid purchase agreements, the Customer must:

  • Keep the Company informed of the Equipment’s location.
  • Not take the Equipment outside Australia without written permission.
  • Not use the Equipment for hazardous or abnormal assignments.
  • Ensure safety and security of the Equipment.
  • Return hired Equipment in good working order at the end of the Term.
  • Not modify or attempt repairs on the Equipment.
  • Ensure that only experienced personnel operate the Equipment.

7. Title and Ownership

For Sales:

  • Ownership remains with the Company until full payment is received.
  • Until payment is completed, the Customer holds the Equipment as a bailee and must store it securely.

For Hires:

  • The Equipment remains the property of the Company.
  • The Customer must not sub-hire, pledge, or alter the Equipment.

In case of default or insolvency, the Company may reclaim the Equipment and recover associated costs.


8. Personal Property Securities Act 2009 (PPSA)

  • The Company retains a security interest in the Equipment until full payment is made.
  • The Customer waives rights under various PPSA sections concerning notification and disposal of secured property.
  • The Company may register a financing statement under PPSA, and the Customer must cover associated costs.

9. Equipment Condition and Risk

  • The Customer acknowledges receiving the Equipment in good working order.
  • The Company is not responsible for incompatibility issues with third-party equipment.
  • A 10% surcharge applies for the return of dirty or improperly packaged hired Equipment.
  • The Customer is responsible for the safekeeping of the Equipment and must pay for any damage or loss.
  • Insurance coverage is available for an additional 10% of the Hire Charge but does not cover specific exclusions (e.g., theft from an unlocked vehicle, misuse, mechanical breakdown).

10. Warranties and Liability

  • The Company makes no guarantees about Equipment suitability for any particular purpose.
  • Liability for breach of warranty is limited to repair, replacement, or refund.
  • The Company is not liable for indirect or consequential losses.
  • Defective Equipment must be reported immediately and may be repaired or replaced at the Company’s discretion.
  • Nothing in this clause limits, excludes or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.

11. Gift Vouchers

  • Redeemable in Videocraft stores and at www.videocraft.com.au.
  • Not exchangeable for cash.
  • Partially redeemable; remaining balance stays on the voucher.
  • Valid for three years from the issue date.
  • Lost or stolen vouchers can only be replaced with proof of purchase.

12. Termination

The Company may terminate agreements if the Customer:

  • Fails to make timely payments.
  • Breaches contract terms.
  • Enters insolvency or bankruptcy.

Upon termination, the Customer must immediately return the Equipment. The Company reserves the right to reclaim Equipment without liability for trespassing or damages.


13. Authority

Anyone signing this agreement on behalf of the Customer confirms they have full authority to do so.


14. Governing Law

This agreement is governed by the laws of Victoria, Australia. Both parties submit to the jurisdiction of Victorian courts.
